By booking a fishing charter, using information on our website, using or chatbot, or using any of our services, you agree to be bound by these Terms. Please read them carefully.
1. Booking and Payment:
1.1. Booking: To book a fishing charter, you must provide accurate and complete information about yourself and the participants, including contact details, number of participants, and any special requirements.
1.2. Payment: Payment for the fishing charter must be made in full at the time of booking, unless otherwise agreed upon with the Company. We accept payment through various methods, as specified on our website or as agreed upon separately.
2. Cancellation and Refunds:
2.1. Cancellation by the Customer: If you wish to cancel your fishing charter, you must notify us in writing or by phone as soon as possible. Refunds are subject to the following conditions:
a. More than 3 days’ notice: 100% refund.
b. Less than 3 days’ notice: No refund.
2.2. Cancellation by the Company: We reserve the right to cancel or reschedule a fishing charter due to weather conditions, safety concerns, or unforeseen circumstances. In such cases, we will provide a full refund or offer an alternative date.
3. Safety and Conduct:
3.1. Safety Guidelines: Participants must follow all safety guidelines and instructions provided by the captain or crew. This includes wearing appropriate safety equipment and following any safety protocols.
3.2. Prohibited Conduct: Participants must refrain from engaging in any illegal, unsafe, or disruptive behavior during the fishing charter. We reserve the right to terminate the charter without refund if any participant’s conduct jeopardizes the safety of others or the vessel.
4. Liability:
4.1. Assumption of Risk: Fishing charters involve inherent risks, including but not limited to accidents, injury, and loss of property. Participants voluntarily assume all risks associated with the fishing charter and release the Company from any liability.
4.2. Indemnity: Participants agree to indemnify and hold the Company, its affiliates, employees, and agents harmless from any claims, damages, or liabilities arising out of their use of our fishing charter services.
4.3. Limitation of Liability: To the extent permitted by law, the Company’s total liability arising out of or related to the fishing charter, whether in contract, tort, or otherwise, shall not exceed the amount paid by the customer for the charter.
5. Personal Belongings:
5.1. Responsibility: Participants are responsible for their personal belongings during the fishing charter. The Company is not liable for any loss, theft, or damage to personal property brought on board the vessel.
5.2. Prohibited Items: Participants must not bring any illegal substances, weapons, or hazardous materials on board the vessel.
6. Amendments and Termination:
6.1. Amendments: We reserve the right to modify or amend these Terms at any time. Any changes will be effective upon posting on our website or other means of communication.
6.2. Termination: We reserve the right to terminate or suspend your access to our fishing charter services if you violate these Terms or engage in any fraudulent or inappropriate behavior.
7. Governing Law and Jurisdiction:
7.1. These Terms shall be governed by and construed in accordance with the laws of New York State. Any disputes arising out of or relating to these Terms or our fishing charter services shall be subject to the exclusive jurisdiction of the courts in New York State.

8.1. Disclaimer of Liability: Sound Strategies is NOT responsible for the accuracy, completeness, or reliability of the information provided by the chatbot. Users should use the information at their own risk.
8.2. No Warranty: Sound Strategies does not provide any warranties or guarantees regarding the accuracy or suitability of the information provided by the chatbot. Users should understand that the chatbot is for informational purposes only.
8.3. User Responsibility: Users (aka visitors) are responsible for verifying and validating any information obtained from the chatbot before making decisions or taking actions based on that information.
